تنازع کشمیر اپنے آغاز کے بعد سے متعدد جنگجوؤں کے ذریعہ جنسی تشدد کے بڑے پیمانے پر استعمال سے گھرا ہوا ہے۔ 1947ء کے جموں کے قتل عام کے دوران ڈوگرا فوجیوں کے ساتھ ساتھ ہندو اور سکھ ہجوم کے ذریعہ اجتماعی عصمت دری کی گئی تھی، [1][2] اور پاکستانی ملیشیا کے ذریعہ جب 1947ء میں تنازع شروع ہوا تھا، بشمول میرپور قتل عام۔ [3]

متعدد اسکالرز اور انسانی حقوق کی ایجنسیاں اس بات پر زور دیتی ہیں کہ 1988ء میں جموں و کشمیر میں شورش کے آغاز کے بعد سے، عصمت دری کو ہندوستانی فوج، [4] سینٹرل ریزرو پولیس فورس اور بارڈر سیکورٹی پرسنل پر مشتمل بھارتی سیکورٹی فورسز نے 'جنگ کے ہتھیار' کے طور پر استعمال کیا ہے۔ [5][6][7] تاہم بھارتی حکومت ایسے الزامات کو مسترد کرتی ہے۔ علیحدگی پسند عسکریت پسندوں نے بھی عصمت دری کے ارتکاب کیے ہیں، جن پر ابھی تحقیق نہیں کی گئی لیکن ان کا موازنہ بھارتی ریاستی افواج سے نہیں کیا جا سکتا۔ [8][9]
